Halloween was filled with more tricks than treats for 49-year-old David Michael Beers, who found himself in hot water after being busted with a pellet gun during a local event.
On Thursday, Oct. 31, the Frederick Police Department was tipped off by a security company contracted by a local church regarding Beers, who was "a known individual who previously exhibited aggressive behavior, (and) had made concerning statements about the church," which was hosting the event at Baker Park that night.
At around 6 p.m., police say that officers on patrol at the event in the area of 200 West Second Street spotted Beers, and they found an apparent firearm in his possession.
Further investigation found that the weapon in his waistband was, in fact, a "Byrna LE" pellet gun, which "closely resembles a firearm and lacks distinctive markings to indicate otherwise, potentially causing alarm to the public."
According to the police, the weapon is not classified as a firearm, but it is now regulated under a recently enacted Frederick City ordinance, which "prohibits the carrying or display of imitation firearms, including pellet guns, in public spaces."
The ordinance states that individuals may not "possess, wear, carry, display, or transport any gun… in any public place… or in any bag, backpack, vehicle, or other article which may conceal the air gun, airsoft gun, BB gun, imitation firearm, paintball gun, pellet gun, or replica gun."
Beers was later found to be in possession of a second loaded pellet gun and additional magazines were found in his vehicle.
The Frederick resident was charged with multiple counts of imitation weapon in city limits.
He was held at the Frederick County Adult Detention Center without bond following his arrest.
